MOTOR VEHICLE ACCIDENT INVOLVING PEDESTRIAN ● WRONGFUL DEATH CLAIM SEEKING PUNITIVE DAMAGES ● DISMISSAL OF CASE

December 2025

Florio adv. Abualsaud (A-23-882820-C) & Florio adv. Williamson (A-25-910821-C)

Our client, a corrections officer, was sued by multiple individuals for wrongful death as a result of a deadly motor vehicle accident involving a jaywalking pedestrian at night. Our client immediately rendered aid to the injured pedestrian, attempting lifesaving measures, and contacted authorities but was ultimately unable to save the decedent's life. Our firm successfully argued that dismissal was appropriate in each lawsuit as: (1) Plaintiff Williamson failed to properly and timely serve a summons and complaint and her complaint, (2) Plaintiff Abuasaud lacked standing to bring wrongful death claims as her parental rights had been terminated by a court of law decades earlier and never restored, and (3) Plaintiff Abuasaud failed to join an indispensable party. Las Vegas Metropolitan Police Department joined our successful motion against Plaintiff Abuasaud.
